National Interest Waivers (EB-2)

The National Interest Waiver is a special EB-2 subcategory that allows applicants to bypass the employer sponsorship and PERM process if they can prove that their work is in the national interest of the United States. This makes NIW especially attractive for researchers, entrepreneurs, and professionals working in fields such as technology, healthcare, environment, or public policy.

Eligibility Criteria (based on USCIS “Dhanasar framework”):

  1. The proposed work has substantial merit and national importance
  2. The applicant is well-positioned to advance the endeavor
  3. Waiving the job offer and labor certification would benefit the U.S.
